Danny Masterson Blames His Lawyer for Botched Defense—Says Crucial Evidence Was Ignored

Danny Masterson, currently serving 30 years for sexual assault, is pointing fingers at his former lawyer, claiming he was given a shoddy defense.

According to Variety, Masterson filed a habeas corpus petition on November 17, requesting that all crucial defense evidence be reviewed—a request his attorney, Philip Cohen, allegedly refused. Masterson argued that Cohen relied solely on cross-examining government witnesses and ignored evidence that could have proven his innocence, leaving the jury with “only the tip of the iceberg.”

Masterson was convicted in September 2023 for drugging and assaulting two women nearly two decades ago. Known for his role on That ’70s Show, the case ended his return to That ’90s Show and led to his removal from Netflix’s The Ranch.

He filed a formal appeal in December 2024. His former lawyer, Eric Mertaub, told the press at the time, “The jury only heard the prosecution’s story. Masterson deserves a trial where the jury hears his side.”
